Smashing Pumpkins Mellon Collie shirt - no copyright mark?

Greetings. I have seen versions of this shirt online both with and without the copyright statement on the front. I was wondering if versions without the copyright on Tultex tag may still be legit? Thanks very much in advance! The pictures are of a shirt without copyright; it is 22 x 29, marked Large. The top pic is from a different shirt that *does* have copyright, for reference.
